What to tell us

  • your name and business name
  • what went wrong, and when
  • what you'd like us to do to put it right

You don't need to use a form. An email or a WhatsApp message is fine. Complaining costs you nothing.

What happens next

Ryan will let you know he has your complaint, look into it and give you an answer as soon as he can. If it's going to take a while, he'll tell you why and when you can expect an answer.

If your complaint is about your personal information

Tell Ryan first, and he'll try to sort it out. You also have the right to complain to the Information Regulator, which oversees POPIA. You can do that at any time.

Our privacy notice explains how we handle your information.

If your complaint is about a funder or a funding agreement

Remember that we don't lend. Your funding agreement is with the funder, and the funder sets the price and terms. If your complaint is about the agreement itself, raise it with the funder through its own complaints process as well as telling us. We'll help you find the right contact.

Where the National Credit Act applies

Some funding agreements are covered by the National Credit Act (NCA). For a business, the NCA usually covers a company or close corporation (CC) only if both its annual turnover and its asset value (counting related companies) are under R1 million. Even then, it doesn't cover a loan or other credit transaction of R250,000 or more.

If your agreement is covered by the NCA:

  1. Complain to the funder first, using its complaints process.
  2. If the funder doesn't resolve it, contact the National Credit Regulator: call 0860 627 627 or email complaints@ncr.org.za. If the NCR finds the matter is one it can deal with, it will ask you to complete its complaint form (Form 29). You don't have to go to an ombud first.

A funder that gives credit covered by the NCA must be registered with the NCR. Its NCR registration number starts with NCRCP. Ask the funder for it, and check it on the NCR's register of credit providers.

Where the NCA doesn't apply

Many business funding agreements fall outside the NCA, for example a larger business, or a cash advance set up as a purchase of future card takings. For these, your route is the funder's own complaints process and what your agreement says about disputes, and the NFO if your funder is a member (see below). Read the dispute part of your agreement before you sign.

If your funder is a member of the NFO

If your funder is a member of the National Financial Ombud Scheme (NFO), which took over the Credit Ombud on 1 March 2024, you can also go to the NFO: 0860 800 900, info@nfosa.co.za. The NFO only takes a complaint once you have raised it with the funder first. It takes complaints from a small business that had turnover of less than R10 million in its last financial year. Ask your funder whether it is a member.

Your right to go to court

Using any of these routes doesn't take away your right to get legal advice or go to court.
